Kroger Co. and energy provider Dynegy Inc. said on Thursday that they had settled a dispute related to electricity contracts made during the 2001 California energy crisis, with Kroger agreeing to pay Dynegy $110 million.
The two companies also agreed to terminate two contracts that were negotiated during the first quarter of 2001, and renegotiated two other contracts.
Kroger had alleged that Dynegy overcharged for electricity service.
The settlement must still be approved by the Federal Energy Regulatory Commission.
